1. Who we are

FiveThirds Construction Consultants Limited (“FiveThirds”, “we”, “us”) is the data controller for the personal information we collect through this website. We are a UK-registered construction consultancy. Our registered office is at Sopers House, Sopers Road, Cuffley, Herts, EN6 4RY.

2. What information we collect

When you submit a form on this website (for example, the “Got a commercial gap you need filling?” lead form), we collect:

• Your first and last name
• The company you work for
• Your role
• Your business email address
• Your business mobile number (if you choose to share it)
• A description of the commercial issue you’re enquiring about
• An indication of how urgent your need is
• The date and time of your submission
• Your consent to us processing your data for the purposes set out in section 4 below

We do not collect special category data (such as health, religion, or political views), and we do not collect financial information through this website.

3. How we collect it

We collect this information directly from you when you fill in and submit a form on this website. We do not buy data, scrape data from third parties, or collect data through cookies for marketing purposes.

We use Brevo (a marketing and CRM platform operated by Sendinblue SAS, France) to process form submissions and manage our contact database. Brevo acts as our data processor under a written agreement and processes data in line with its own privacy obligations under the EU GDPR. 4. What we do with it

We use your information to:

• Respond to your enquiry directly, usually within 24 hours
• Assess whether FiveThirds can help with the commercial issue you’ve described
• Schedule a follow-up call or meeting if that’s helpful to you
• Hold a record of our correspondence in our CRM (Brevo) so we can pick up the conversation if you come back to us in future
• Send you occasional follow-up emails relating to your specific enquiry

We will not use your information for any other purpose, and we will not pass it to any third party for marketing, sales, or any other commercial purpose.

5. Our lawful basis for processing

We rely on two lawful bases under the UK GDPR:

• Consent (Article 6(1)(a))

You have ticked the consent box on the form. You can withdraw that consent at any time by emailing sahonsi@fivethirds.co.uk.

• Legitimate interests (Article 6(1)(f))

Where we need to retain a record of your enquiry to manage our business operations and respond to follow-up communications, we rely on our legitimate interest in operating a B2B consultancy. We have balanced this against your rights and concluded that the impact on you is minimal.

6. How long we keep it

We retain your information for 24 months from the date of your last contact with us, after which it is deleted from Brevo and from any FiveThirds systems.

If we enter into a contract with you or your company during that period, we will retain your data for the longer of:

• The duration of the contract plus seven years for accounting and tax purposes
• Any longer period required under our professional obligations as an RICS-regulated firm

7. Where your data is held

Your information is processed in the European Union and the United Kingdom. Brevo stores customer data within the EU (primarily in France and Germany). We do not transfer your data outside the UK or EU.

8. Your rights

Under the UK GDPR you have the right to:

• Request a copy of the personal data we hold about you
• Request that we correct information that is inaccurate or incomplete
• Request that we delete your information (subject to any legal or professional obligations to retain it)
• Restrict how we use your information
• Object to our processing of your information
• Withdraw your consent at any time
• Lodge a complaint with the Information Commissioner’s Office (ico.org.uk) if you are unhappy with how we have handled your data

9. Security

We use Brevo’s GDPR-compliant infrastructure for data storage, with encrypted data transfer (TLS) for all form submissions. Access to your data within FiveThirds is limited to staff who need it to respond to your enquiry. We do not store your information on personal devices.

10. Changes to this notice

We may update this notice from time to time. The current version is always available at fivethirds.co.uk/privacy and is dated at the top.
